Soon after Napster&#8217;s inception on June 1, 1999, the recording industry sought to shut it down.<\/p>\n\n\n\n<p>As Napster fought for its life in court, users continued to rip CDs and upload tunes to their computers and the file-sharing network for others to download. By then, Apple had launched its iTunes Store for customers eager to pay for songs and albums. When downloaded and installed on a personal computer, the Napster software enabled users to search millions of MP3 song files on other people&#8217;s computers that also had the software. Napster took its name from Fanning&#8217;s moniker, which he received as a result of his haircut.<\/p>\n\n\n\n<p>Fanning would end up on the cover of Time magazine, and Napster would also appear on the cover of Newsweek.<\/p>\n\n\n\n<p>However, the recording industry had a different opinion on Napster, criticizing how the network allowed users to distribute music anonymously, which went beyond the customary &#8220;fair use&#8221; of sharing copyrighted work with friends if you weren&#8217;t earning.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"640\" height=\"427\" src=\"http:\/\/radiantmedia.io\/wp-content\/uploads\/2024\/06\/c04d4ad3a0559955480970d75a6d40ab.jpeg\" alt=\"\" class=\"wp-image-30420\" srcset=\"http:\/\/radiantmedia.io\/wp-content\/uploads\/2024\/06\/c04d4ad3a0559955480970d75a6d40ab.jpeg 640w, http:\/\/radiantmedia.io\/wp-content\/uploads\/2024\/06\/c04d4ad3a0559955480970d75a6d40ab-480x320.jpeg 480w\" sizes=\"auto, (min-width: 0px) and (max-width: 480px) 480px, (min-width: 481px) 640px, 100vw\" \/><\/figure><\/div>\n\n\n<p><\/p>\n\n\n\n<p>According to Joseph Menn&#8217;s book &#8220;All the Rave: The Rise and Fall of Shawn Fanning&#8217;s Napster,&#8221; the Recording Industry Association of America labeled Napster as &#8220;a safe haven for piracy&#8221; in its December 1999 complaint charging copyright infringement.<\/p>\n\n\n\n<p>According to The Wall Street Journal, the RIAA&#8217;s lawsuit demanded $100,000 for each copyright-protected music shared on the network, or approximately $100 million.<\/p>\n\n\n\n<p>Metallica, Dr. Dre, and other bands had problems with Napster.<br>While some musicians backed Napster and urged labels to adopt a subscription service, others were more outspoken in their criticism of the company&#8217;s shortcomings.<\/p>\n\n\n\n<p>Among them are the rock band Metallica and record producer and rapper Dr. Dre, who filed their own copyright infringement lawsuits shortly after the RIAA sued on behalf of the record labels.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"168\" src=\"http:\/\/radiantmedia.io\/wp-content\/uploads\/2024\/06\/images-1.jpeg\" alt=\"\" class=\"wp-image-30421\"\/><\/figure><\/div>\n\n\n<p>Metallica handed boxes of files in May 2000, citing more than 300,000 Napster users who had downloaded Metallica tracks, including a demo version of the song &#8220;I Disappear&#8221; from the &#8220;Mission Impossible 2&#8221; soundtrack before it was released for sale.<\/p>\n\n\n\n<p style=\"font-size:16px\"><strong>READ MORE: <a href=\"https:\/\/radiantmedia.io\/2024\/04\/11\/music-industry-addresses-ai-compensation-issue\/\">Music Industry Addresses AI Compensation Issue<\/a><\/strong><\/p>\n\n\n\n<p>&#8220;It all began when a man posted a song on the Internet that we hadn&#8217;t finished mixing yet. In 2003, Metallica drummer Lars Ulrich told USA TODAY, &#8220;I wanted to know where it came from.&#8221; &#8220;Things changed drastically from there. It was never about money or greed; it was about control. I don&#8217;t mind giving (music) out, but I want to choose what to offer.&#8221;<\/p>\n\n\n\n<p>While Ulrich and Metallica received a lot of criticism from the media and fans for their stance, they had a valid argument. &#8220;File sharing is synonymous with music piracy,&#8221; Pohlmann explained.<\/p>\n\n\n\n<p>&#8220;Napster tapped into an anti-establishment sentiment that supposed that the music industry was ripping people off,&#8221; he stated. &#8220;Some clients took great delight in turning the tables and taking advantage of the industry. What they overlooked was that they were also stealing from the musicians.<\/p>\n\n\n\n<p>Other artists were also outraged, if not as visible. Eminem had to rush the release of the track &#8220;The Real Slim Shady&#8221; from 2000&#8217;s &#8220;The Marshall Mathers LP&#8221; after it leaked on Napster. It was as if music should be free,&#8221; says Marshall &#8220;Eminem&#8221; Mathers in the upcoming two-part docuseries &#8220;How Music Got Free,&#8221; which airs June 11-12 on Paramount+. He, along with LeBron James, serve as executive producers.<\/p>\n\n\n\n<p>&#8220;Then it&#8217;s like, OK, so here&#8217;s what you don&#8217;t understand (about) music: it should be free. &#8220;I have an engineer to pay,&#8221; he explained. &#8220;There&#8217;s an army of people that work at Interscope (Records) that need their paycheck.&#8221;<\/p>\n\n\n\n<p>So, what happened with Napster?<br>A federal judge rejected Napster&#8217;s claim that users were just space-shifting their music because other users could download songs they did not own before.<\/p>\n<\/blockquote>\n\n\n\n<p>Napster paid $26 million to settle separate suits filed by music publishers and songwriters, but in June 2002, it filed for bankruptcy when the court ruled in the record companies&#8217; cause.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"http:\/\/radiantmedia.io\/wp-content\/uploads\/2024\/06\/Napster-Logo-1999-1024x576.png\" alt=\"\" class=\"wp-image-30423\" srcset=\"http:\/\/radiantmedia.io\/wp-content\/uploads\/2024\/06\/Napster-Logo-1999-980x551.png 980w, http:\/\/radiantmedia.io\/wp-content\/uploads\/2024\/06\/Napster-Logo-1999-480x270.png 480w\" sizes=\"auto, (min-width: 0px) and (max-width: 480px) 480px, (min-width: 481px) and (max-width: 980px) 980px, (min-width: 981px) 1024px, 100vw\" \/><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>Meanwhile, the recording business began to sue those who shared or downloaded music. It&#8217;s easy to look back and see how such a complex issue transpired and how you could have made better decisions, but overall, it was a fantastic experience.&#8221;<\/p>\n\n\n\n<p>At the time, Fanning had sold Rupture, a network that connected video game gamers from various systems, to Electronic Arts. Fanning went on to co-found Helium, which develops wireless networks for internet-connected products.<\/p>\n\n\n\n<p>Echoes of Napster&#8217;s adventure may be found in current news, with TikTok and Universal Music feuding &#8211; with Taylor Swift&#8217;s music being removed from the platform &#8211; until reaching an agreement in early May.<\/p>\n\n\n\n<p>Sony Music has warned artificial intelligence developers against using its music to train AI models.<\/p>\n\n\n\n<p>In 2009, Fanning remarked of the music industry, &#8220;It is extremely difficult to make anything creative. (You&#8217;re) dealing with a lot of folks who aren&#8217;t excited about the prospect of their business model changing.&#8221;<\/p>\n\n\n\n<p>Is Napster still available today?<br>Napster is still playing music, but as a subscription service, with only a fraction of the customers held by prominent competitors such as Apple, Amazon, Spotify, and YouTube Music.<\/p>\n\n\n\n<p>Many people believe the brand has potential because it has changed ownership multiple times, including being owned by Best Buy in 2008 and merged into the Rhapsody music business, which purchased it in 2011.<\/p>\n\n\n\n<p>It is presently owned by a private consortium led by Hivemind Capital, an investment business that focuses on digital media, cryptocurrencies, and blockchain technology.
